Yes catherwood, that is most certainly the movie I was thinking of, the same diner scene as well. Although it appears I was off on some details, that pic of Bill Pullman put it all together for me, the movie is;

I have a guess but I can't remember the name of the movie... or really what it's even about. Maybe late 80's early 90's I think there's an eccentric shut in rich guy who hires an assistant to help him solve some sort of mystery... and there's a scene in a diner with the assistant(?) and a girl possibly eating ice cream...
I'm probably be wrong but the hell is the movie I'm thinkng of?
