[META] Card Scans - Legal Issues Okey, due to various discussions about the cards and the legality of scaning and uploading, i emailed Mind Candy to check what they thought on the matter. Heres the response:

Hi Nik,
We're still discussing this question here at Mind Candy. Basically, for
legal reasons, we can't allow the entirety of the cards to be scanned
at high resolution and then put online. However, we can allow pretty
much everything else, including:
- low to mid res scans of both sides
- plain text transcriptions of any text on the cards
- magnifications of limited, selected areas of the cards (to show
specific areas of small detail)
We will be coming up with a full policy regarding scans very soon and
posting it on mindcandydesign.com. From our point of view, it's in our
interests to work with the community and to allow images of the cards
to be shown online - but we can't allow you to scan the cards in at
high res because that would cause problems in future when we are
protecting our copyright in other areas.

Basiclly the Wiki WILL abide by this, as i dont want my ass sued over this
I'm going to reduce the scans to less than 300x500 tonight until we have definite clarification on what low/mid/hi res scans are classed as in there eyes
Of course we have the whole personal use thing blah blah, but thats up to your own interpritation, any updates or futher corospondance ill put em in this thread.

It might be worth asking MC about any map pieces as a separate issue, without the high res scans it would not have been possible to link together the pieces that we have, it has involved blowing up from the tour guide etc and you lose masses of details. I'm totally not saying go against whatever we are told, just that lack of detail on maps will make them impossible to solve.

Well it's not the end of the world. And so long as specific kloo areas are scanned in then it's all good, surely.

Okey, all old scans have been deleted and replaced with 300x450 or less versions....this is hopefully until we get a size guide from MC

I think its a fair request from MC regarding High Res scans. They want us to share information, but with a high res scan it makes it too easy to create forgeries.

I don't think that forgeries of their puzzle cards is really what MC is worried about. I mean, who is going to spend the time to create quality forgeries of these things to resell? There wouldn't be any profit in it. I think they are more concerned about their intellectual property down the road.

I was wondering if we could just slap a fact [COPY] on the scans via Photoshop over any part of the cards that isn't needed to solve the puzzle. Should have asked if it could work earlier though... hmm.

I would have thought that too till I saw the Perplex City parcel on ebay...if it was a very rare card someone would buy it....

I hope they allow a reasonable size for the card scans, because as of now there might as well be no scans at all. You can't even read the text on them. I'm hoping they allow them to be scanned in high res with the words copy over them or something.
Kind of defeats the purpose of a team game when we can't easily work together.

but we are allowed to transcribe them in plain text novacaineX, which would eliminate the not being able to read the scans aspect, and important parts of the cards are allowed to be magnified

Hopefully we won't need to make them as small as they are on the wiki at the moment. It would be worth contacting them and asking exactly what resolutions they mean by "low to mid res". To me, "high res" would be 300 dpi or more, which is what you would need to get a decent quality printout, but above and beyond what you'd need just to read it onscreen.

That seems fair enough to me. If they are trying to fund this game, and the massive prize, by selling these cards, then it's not exactly fair if we just boycott the cards and check them out online. I think they're being quite reasonable about it.

IANAL, but my understanding of copyright law in the US is that if you are aware of someone infringing on your copyright and don't do anything about it, you give up your right to go after other infringers in the future. Basically, you have to either go after every infringer or you can't go after any of them. I suspect MC could come up with some sort of formal agreement that lets unfiction, and/or other web sites, post high-rez scans of the card that would still let them go after other infingers, but I don't see how MC benefits from something like that.
I think the low-res scans plus transcriptions of the text will be plenty of information to solve the puzzles on the cards. If there's some detail that someone really wants to be able to look at, they can just go get the card. I suspect they'll be plenty of card-trading going on.

we have contacted them again asking Adrian and co what they classify has high/med/low res. If they are too busy to reply then the scans will stay the way they are on the wiki atm

would it be morally bankrupt to suggest an offshore hosting location which would not succumb to American or European copyright legislation? It would incorporate the spirit of ARGs using the internet as a global playing fField, eh.
