Spontaneity in ARGs

This is something that interests me, and seems to be the major problem with ARGs becoming a mainstream media. This was seen (to a point) in Neurocam, and ILB.

Anyone know the current legal classification of ARGs? If someone playing your ARG does something stupid, can it all come back on you (the puppetmaster)?

If you read the meta sites for most games they have a quasi legal disclaimer that states: Do not do anything illegal for this game. Players are responsible for their own actions.
