Overnight

I'm not an expert so I could be off base but, a little research turns up a bad B movie made around 2004 called "Overnight" so, title rights may be overcome but, I highly doubt Paramount would want to use a title that already has a bad film associated with it.

Tahe the "LLC" off your Google search; people only use that on corporate documents, not websites.

There are a billion "Group One Productions" companies out there, it seems.

How did you happen to "stumble across" this, might I ask?

Yes, there are a lot of Group One Productions, but none that I found that had a relationship with Jackoway.

Here is how I came across this:

I looked up Slusho in TESS.

The Attorney of Record (i.e., who filed the paperwork) for Slusho is Lori Boatright.

I then searched for all other records with Lori Boatright as the attorney, in hopes that she filed the trademarks for the movie name as well.

"Overnight" showed up, I searched for Group one and Jackoway Tyerman Wertheimer and made the connections.

i personally can see the movie being called overnight, like a day after tomarrow deal, because they alkl had great normal lives then overnight their lives are different

Er... Neither films are like that. This is called Overnight because it takes place overnight, and The Day After Tommorrow was called that because one of the characterspredicted that the disaster would happen on the day immmedietly following the next day.

The other way around is far more likely.

Didn't we long ago agree that slushozoom.com is gamejack?

And nice work on Overnight research.

Yeah, and a painfully obvious one, but people don't seem to be getting the memo.

FYI: Paramount Pictures is registered in Delaware.

According to Google searches...

Quote:
Paramount Pictures Corporation ("Paramount") is a Delaware corporation with a principal place of business in Los Angeles, California.

Thousands and thousands of companies are registered in Delaware due to some special tax sheltering or something- litterally thousands that means nothing in and of itself. You hear "a Delaware Corporation" all the time in business, I'll reasearch exactly why that is if you wish...

RE: Delaware Corporations Information

From http://www.corp.delaware.gov/faqs.shtml#numcorps: FAQs

Quote:

Why do so many companies incorporate in Delaware?

Businesses chose Delaware not for one single reason, but because we provide a complete package of incorporations services. The Delaware General Corporation Law is the most advanced and flexible business formation statute in the nation. The Delaware Court of Chancery is a unique 210 year old business court that has written most of the modern U.S. corporation case law. Delaware's State Government is business-friendly and accessible. Our Division of Corporation is a model state-of-the-art efficiency and our staff provides prompt, friendly and professional service to clients, attorneys, registered agents and others. These factors have all contributed to making Delaware a premier legal home to companies around the world.

Do I have to live in Delaware to have a Delaware corporation?

No. Delaware law requires every corporation to have and maintain a Registered Agent in the State who may be either an individual resident, a domestic corporation, or a foreign corporation authorized to transact business in Delaware whose business office is identical with the corporation's registered office.

Must I use an Attorney to incorporate?

No, but you should contact an attorney concerning legal matters. The Delaware Division of Corporations acts solely in an administrative capacity and does not provide legal advice.

This attorney is probably their Delaware Agent- not that mgith mean that anything to do with 'Overnight' might be just another client that is unlrelated if the attorney is also the agent for any number of other business entities but I don't know it might be potentially relevant.

I recently stumbled upon trademark #77232885, "Overnight." It was registered to Group One Productions, LLC, and Jackoway Tyerman Wertheimer on July 18, 2007, and described as "motion picture, television and music production and distribution services."

Emphasis added by me.

1) Movie names are not trademarked, and there is no legal precedent for trademarking a movie name.
2) Movies are not production or distribution services.
3) Movies are not services of any kind, they are products.

Just to clarify.

Not to mention July 18th would be a bit late for submitting a trademark application for a movie.

Here's the trademark description for Transformers (#78909808):

"Entertainment services, namely, production and distribution of movies and on-going animated television series"
