Amazing flash! I heard about the fanfic thing too, so pretty sure it's not the HP ARG we've heard about :p I kind of got the impression that would be a little less...professional than this appears.
But whatever this is, there's no money being made so...what's the objection?

That's a common misconception: it has nothing to do with directly making money. Picture someone making a comic book with Mickey Mouse and friends smoking pot and otherwise acting unsavory.* It's detrimental to Disney, the copyright holder, to allow such a thing to exist: the comic book maker, even if they're not selling it, is damaging Mickey Mouse's good name. They have every right to control how he is used, as the copyright holder, and no one else should be able to misappropriate him.
You could easily say that this doesn't look like it's damaging Harry Potter's reputation. And, judging from the high quality, I'd agree with you. At the same time, though, if JK Rowling ever wanted to make a sequel, this has stolen a bit of the thunder. Picture if hundreds of people did likewise: made high quality knock-offs. It would damage her ability to make more Harry Potter books if she so chose. At the same time, those individuals don't own the copyright on her characters or universe, so they would be infringing to use it without her permission. She worked hard to build up the Harry Potter name, and someone else shouldn't be able to piggyback on that work without compensating her.
What it comes down to is that if you make something, and have it copyrighted (which you get automatically by virtue of "publishing" it) you own an exclusive monopoly on its use. If you want to prevent other people from using it, you can. That's your right, granted by the government. And even if someone else is doing a really good job of it, you can simply tell them they're infringing, for any reason of your choosing.
Make sense?
*Which, of course, actually happened.

Yup, I see what you're saying, Satire. Thanks for clarifying all that.
I've only ever had copyright issues with a band website (thecure.com) who placed a picture that i took on their site without credit. They won't remove it. And I basically have no say in the matter because they're not directly making money from it. I figured it would be the same in this case, but i do see how there is more at stake regarding reputation and all.
I do think having the info about it being unrelated hidden behind password is very sneaky. Some kids will easily take it on face value.

I'm not sure on the specifics of your case, but that sounds like straight-up copyright infringement. They can't throw your picture on their site without your permission, period (with exceptions). And particularly if they refused to remove it after you asked, that's a pretty clean case, whether money was involved or not.
If they're still doing it, you should ship them a cease and desist letter.

She has said in numerous interviews how much she hates it, and once and only once i saw her say that for the most part, not much she can do. HOWEVER, i am certain that she could do something about this CF.
IF you read the wiki entry here: http://en.wikipedia.org/wiki/Legal_disputes_over_the_Harry_Potter_series then you will see the MANY legal issues that have come about due to the high profile copyright infringment - commericial and non {and yes, it does go both ways, and yes that includes Warner Bros as well}. I am sure if this becomes high profile, without prior permission, it WILL go down. If it is grassroots, I doubt the creators will want to go to court over it.</META>

It might be a bit quick to dismiss things as being 'pretty sure' that it isn't the HP ARG that's been bandied about before, short of absolute denial by the Hogwarts Experience. Just because it's connected to a particular fanfic already doesn't rule out the possibility of them being connected in some fashion. Keep in mind, I don't know for sure either.
Watching this one, however, either for the opening or what will be yet another charming footnote closed down by legalese.

Seriously though, I can see how this doesn't seem to go against anything JK and her lawyers allow in the sense that it appears to be fanfic and it doesn't SEEM to be explicit or actually printed.
However, it's presented as pretty real to someone who wouldnt know any better. It says the usual copyright blurb and it's not until inside with the passwords that is says it's NOT related. I think that's kind of...crossing the line. Especially when kids are involved.
Annnyway, sorry for being offtopic, I know none of this has any bearing on us as players/viewers/whatevers.
