PORT ST. LUCIE — Melissa Barton said she is considering legal action after her son's kindergarten teacher led his classmates to vote him out of class.

After each classmate was allowed to say what they didn't like about Barton's 5-year-old son, Alex, his Morningside Elementary teacher said they were going to take a vote, Barton said.

By a 14 to 2 margin, the class voted him out of the class.

Barton said her son is in the process of being diagnosed with Aspberger's, a type of high-functioning autism. Alex began the testing process in February for an official diagnosis under the suggestion of Morningside Principal Marsha Cully.

Alex has had disciplinary issues because of his disabilities, Barton said. The school and district has met with Barton and her son to create an individual education plan, she said. His teacher, Wendy Portillo, has attended these meetings, she said.

Barton said after the vote, Alex's teacher asked him how he felt.

"He said, 'I feel sad,'" she said.

Alex left the classroom and spent the rest of the day in the nurse's office, she said.

Barton said when she came to pick up her son at the school on Wednesday, he was leaving the nurse's office.

"He was shaken up," she said. Barton said the nurse told her to talk with the child's teacher, who told her what happened.

Alex hasn't been back to school since then, and Barton said he won't be returning. He starts screaming when she brings him with her to drop off his sibling at school.

Thursday night, his mother heard him saying "I'm not special."

Barton said Alex is reliving the incident.

They said he was "disgusting" and "annoying," Barton said.

"He was incredibly upset," Barton said. "The only friend he has ever made in his life was forced to do this."

The child's mother filed a complaint with the school resource officer, who investigated the matter, said Port St. Lucie spokeswoman Michelle Steele said. But the state attorney's office concluded the matter did not meet the criteria for emotional child abuse, so no criminal charges will be filed, Steele said. Port St. Lucie Police is no longer investigating, but is documenting the complaint, she said.

Steele said the teacher confirmed the incident did occur.

St. Lucie School's spokeswoman Janice Karst said the district is investigating the incident, but could not make any further comment.

Vern Melvin, Department of Children and Families circuit administrator, confirmed the agency is investigating an allegation of abuse at Morningside, but said he could not elaborate.

I highly suggest that as a sort of 'protest' donations of the book Lord of the Flies be made to the school district, so that educators might explore the negative results of such behavior with students of a suitable age. I wonder if that teacher had ever read the book, or even seen any version of the film?

Wow, there is no behavior at that age that warrants thatkind of cruelty. That teacher's name should be displayed alllll over the internet, so that her bad decision follows her for life. Good lord. 5 years old. Funny how they're still growing- still learning so much and adapting to public school- but such unkindness at that age could also impact him for life.
My aunt (she's a teacher) had a great quote once. There are 2 kinds of people who go into teaching; those who love kids and want to make a difference, and those who just want to be the boss of people.

This only goes to prove what our public schools have turned into.I watched the child's mother being interviewed by Harry Smith on CBS this morning,whenever the mother started to make a point,he cut her off.The ACLU should get involved but probably won't.

5yr old voted put of school

My son is "ASPERGERS SYNDROME" also he was diagnosed 6 yrs ago. Not only are the children ignorant to this syndrome MOST TEACHERS ARE TOO.... They told me to quit taking up for my child and he was "JUST LAZY"...He was different he just didnt fit in with everyone else, he would get lost in the middle of a subject,even got an award for "DAY DREAMING". The principal at our school in Fla. told my son in the 6th grade he would be a serial killer by the time he was grown because he drew stick figures and put guns and knives in their hands and had blood drippong from them it was in cartoon captions. He still doesnt know what the big deal was. Besides that he is also "OCD" and fights everyday to just get through school,he stays to him self most of the time. Aspergers is a very complex syndrome and there is an excellant website "THE AUTISM TREE" the essential guide to autism and the essential guide to Aspergers Syndrome. Autistic child voted out of class
Asperger's

My son is eight and was diagnosed when he was seven with Asperger's Syndrome. He has always been "different" from all of my friends' children. His disability is not a "physically visible" disability which can gain assistance and sympathy from others. His brain sees the world in a completely different manner from the "majority". That being said, since no disability is physically apparent - he is instead seen like a "trouble-maker" - or "lazy", just like Melissa Barton's son. People are quick to put down the down and out and fervent about lifting up the already successful. Seems a bit backwards to me. We have to fight for our children and perhaps homeschooling is a better idea for our little guys who don't deserve such emotional scarring received on a daily basis from the ignorance of the "majority" in the public spectrum.

I don't know if any of you read poetry, but I teach creative writing in RL. I know various forms of autism have been written about by many prople, but I'd like to recommend 'The Spaces Between Birds: Mother/Daughter Poems' by Sandra McPherson (Wesleyan Poetry). A sad/happy/inspirational but definitely non-sappy collection. Sandy is a wonderful poet with a long track record.

Fight the good fight, folks, and my thoughts are with you.
