[META] Terms of Use Contract

Some players have been surprised to discover their photos on McDonald's advertising websites in Japan. The Terms of Use contract for this ARG is worth a look for those who haven't read it yet. It's located through a small link on the lower left corner of the main FtLR page:

Quote:

Your User Generated Content is not confidential or proprietary. You grant to us a non-exclusive, non-revocable, worldwide, perpetual right to use your User Generated Content in any manner or media now or later known without limitation including but not limited to the right to sublicense and assign and commercialize without any compensation due to you.

Again, this means that any photos or videos or other content that you upload to game websites is owned by the McDonald's Corporation and can be used in their advertising campaigns.

I also just enjoy this part:

not owned, they just can use it whenever and however they please

One question is, what recourse do players have once their images are in circulation on the McDonald's corporate sites if they are unhappy about their faces being used to advertise? For example, the NZ Labyrinth Running Team was not informed when their photos were used on this McDonald's Japan ad website, here: http://www.mcdonalds.co.jp/thelostring/ The Terms of Use contract stipulates that by simply posting content to the game sites, players waive right of consent and compensation. See unagi's post under the McDonald's Ad thread.

If you post to any of the Lost Ring forums, then that content would be in "game websites."

But, just to be clear, sites such as Flickr and this Unfiction unforum are not "game websites" and therefore anything posted in these places would not be under the Terms of Use Contract thumb, as it were.
