Hello,

First time poster, but long time lurker, and sometimes prop maker enthousiast.

I'm not a lawyer, but I think it is reasonable to think that creating brand new stuff from movies ( not recasting stuff licensed by marketing partners ) is tolerated. Of course, it is illegal in itself, but what does the majors have to win by suing a fellow who is doing a small run in his garage, for fun and minimal amount of money ?

Lucas went on the laser because it was commercial from the start; But nothing went on the Sabersmiths, who do sabers all the time ( and it's clearly IP related ) for sometimes a lot of money.

It keeps the franchise alive, the fans hyped up, and creates a community of enthusiasts. Which is all good for the IP owners, and for free.

My humble advice would be to enjoy making your props, do some good job, and stay humble.

Oh, and last thing : Replica prop forum. Go there. Enjoy. :p

Might want to ask around in the arcade collecting community, some of the repro guys there have dealt with Disney/Tron stuff before.
Specifically, the guy who runs http://phoenixarcade.com might have some pointers. Or ask in the forum at klov.com (where you could sell a ton of 'em if the price was right)

Good luck, I'd love something bigger than my Medicom recognizer!

well.

I keep looking on ebay and there are plenty and plenty of movie props that are unlicensed and even some star wars stuff.

Doesn't mean I am going to rush ahead on this.

We had simply tossed the idea around, and this is so theoretical.

If we do a second run of "geometric answers" then I think it would be fun to use the profits from that to do this. I would personally be hand painting each one unless we had enough to pay someone to do it.

I am not sure.

It would just be nice if I was missing that part of the brain where I can throw absolute caution into the wind in spite of a heavy lawsuit, but I don't think they would go that far with it.

Only time will tell.

The answer depends on the question you are asking.

If you make a small run of Recognizers, will you get sued? Probably not. Will you get a C&D? Maybe. I did.

If you make a small run of Recognizers, is it legal? The answer, is, very clearly, no. Disney owns Tron. Even your bits. They aren't being sold on "geometry." You're selling TRON geometry. You're selling a product using the interest garnered from their property, without a licence.

You are operating in the gray area, make no mistake about it. I do it all the time, but have no illusions about what I'm doing.

Ok I read that, but I have no idea what it means. I have never claimed to be a genius, the reason I got my degree in Graphics Design and my Masters in Animation was because I flunked out of business school and would have done just as badly in legal school.

I understood 5% of the words in that article, so I don't know if that article is saying "do it" or "don't do it"

I am a lawyer, with experience in IP and business law. That being said, the disclaimer - this is my personal opinion, not an offer of legal advice and, as such, I will not be held liable for any use of it.

First, the "Bit" - the "Bit" is copyrighted as a character in Tron. That's where Disney receives protection for that particular idea. Creating similar geometric shapes and calling them geometric shapes and not "Bits" definitely helps. Could Disney try to C&D you, yes - would they, probably not since its not a big commercial run and there is sufficient ambiguity.

As for the "Recognizer", that's a totally different story. They could sue you, the usual way things like this are handled is to issue a C&D first and if you comply then it goes away. It happens regularly. They could sue you as well and the damages are set by Federal statute and can be significant. That being said this isn't a big run so a C&D is most likely if they notice. Its a sensitive time in Tron marketing with many of their partners selling similar items so IMHO I wouldn't try it right now.

I did a small run of Grape Soda Bottle caps (can't get much more generic than that) from UP, and got slapped with a C&D right away. They must've gotten tired of it, though, because I see them all over etsy.

UP is a more recent movie though, we are talking about a 30 year movie, that was a flop in the theaters. The toys were so limited that even 30 years ago they weren't available.

Disney DID do Grape soda bottlecaps, in fact there are a bunch on ebay. So what you were doing DID coincide with something that they were already doing.

There were NEVER recognizer toys, replicas, and I doubt Disney will EVER do them.

There are however images on the space paranoids pin, medicom did small ones, but I would never recreate what someone has already done.

I was just going to say, Medicom did do a nice Recognizer replica as part of the Kubrick sets back in circa 2002... but fairly limited run and only available in Japan, so not sure if it applies here.

That and the friggin' thing was blue. We all want a bad-ass black with red outline Reco to put on the shelf Smile

Well I even stated that medicom did them. I would also want to do the blue and white one, but yeah it would also be cool to have the red and black.

I would want these to be bigger, since they are simple shapes I wouldn't have to have them lasered out...maybe.

I would want these 12" tall if I did them which I may not at this point.

We will see.
