New press release at NRU puts these legal docs in context.

Information Released in pre-trial motion for Starkey
Friday Oct 11, 2003, 4:33 p.m. MST
New River University (NRU Press)
In a surprise move Jacob Starkey's attorney Stephen Lake made to successful motions before federal court this afternoon. Lake, successfully requested disclosure of the federal government's case against Starkey. "This young man is a scapegoat, we all know it. What we have here is a government cover-up for something the public isn't privy to.", Lake said today while escorting Starkey back onto campus after being freed on a one-million-dollar bond. Starkey will be allowed to return to class but will be banned from all former research. In his only public statement, Starkey apologized to his wife for "putting her through all of this stress," and said he was "innocent beyond a shadow of a doubt."

INFO: Affidavit at L3 Descrepancies

I'm no lawyer, but I see descrepancies in the "affidavit that shows the charges against Starkey are false" in dates and office room numbers .
Dates
Jake was arrested October 08, 2003. Yet the affidavit is...
Quote:
Sworn and Subscribed to before me
this 21 day of February, 2001
[signed: Alan Kay]
UNITED STATES MAGISTRATE JUDGE

Office Room #
Quote:
A) The personal office space of JACOB WYATT STARKEY within Room 212, V.A. Fock Center for Theoretical Physics, 2300 Saguaro Avenue, Catalina, Arizona.

6. As noted since January 06, 2001, STARKEY has occupied an office in Room 210 of New River University's VA FOCK CFTP, 2300 Saguaro Avenue, Catalina, AZ.

Incidentally, Aslam Moeck, a guest lecturer for the physics dept., is in room 210, and Dr. Zeladzny's office number is 105.

Um... Since the above ground portion of the building wasn't occupied until this year, (per conversation with Caretaker the lower levels were operational about a year ago) I don't think anyone was in any of the Fock center offices, at least not any of the ones above ground.

Where does some security dweeb from NRU get the authority to tell the FBI to withhold information from their affidavit in support of the application for a search warrant? Odd. I would expect the FBI to just say that supplemental classified material was submitted separately under seal for consideration by the judge.

L3 Yahoo email

In Addlepated's guide, she mentions on Nov. 23,

Yahoo Mail for Landau, Luckman & Lake login:

landau_luckman_lake/5usc552

FYI, 5 USC 552 is the section of the United States Code that directs federal agencies to have a publicly available policy on public information; relates to the FOIA concept.

Yep, that was one of the solves from the pre-game. Someone (Aliendial?) was given a card that had "FOIA" on the back, but FOIA didn't work anywhere as a password. Eventually the code was tried, which worked.
