As for Mr. Belcher, what I've got to say is that you're in a legal bind. You don't own the name "Slenderman", nor the character archetype. If it goes to court, you're going to have to prove that you're not infringing upon Victor Surge's copyright.

My personal opinion is that he shouldn't even have that copyright, given that he created and abandoned the character four years ago now, but "shouldn't" doesn't mean "doesn't".


Apparently the character is in the public domain, but the name isn't.

However, I agree with you. He shouldn't have that copyright.


If you would look into the other thread -- the one about the Slender Man game blocked on Steam -- it will be noticeable that it is not possible to copyright a name. Names are trademarked. Which makes this even weirder...

 		Okay food for thought.

Did anyone ever copyright vampires? Or the concept? Or even the name "Dracula?"

Ditto for zombies.

Ditto for ghosts.

(etc..)

So, given the fact that as far as I know, you cannot copyright words in the English language, and you cannot copyright vague character descriptions (aka unnaturally tall with no face and dressed in a suit- which is pretty damn vague, all things considered), how is this an issue.

I mean. REALLY. Money has been made off of Slender Man/Slenderman/ The Slender Man/Slendy/Slondors/EVERY damn incarnation of said tall suited man. At this point, there are multiple wikis/forums/facebook groups/Minecraft servers/tinychats/skypecalls related to Slender Man. If legal action is being taken, why hasn't the rest of the 'Verse been served with papers?

 		Correct me if I'm wrong, but hasn't Surge gone on record to say that he would never stop people from making productions about Slender Man?

I'm not sure how much of this story I'm willing to buy. For all I know, this is just a publicity stunt.

That smart? Dude, a stunt like this take five, maybe ten minutes of planning at best. Hell, 20dollaz whored himself out every chance he got.

Like it has been said, Surge made Slender Man public access. Anyone can use him. If the guy was gonna start making lawsuits, every single Slender Man vlogger/game developer/film maker and their mothers would all be screwed by now.

I mean, money has already been made off of Slendy. So it's a little late for ol' Tricky Vicky to start getting picky.

 		We aren't getting the whole story, and I will not support someone that doesn't give us all the facts. Clearly you are trying to do something that is a violation of what Victor Surge and the entire verse is all about. The community is fine, and protected just fine. Besides, the community won't die if vlogs aren't allowed to market their product for profit anyway.

It is true that vampires, zombies, etc. are all "vague character descriptions" as you put it, & all public domain. However, correlation=/=causation. These are all public domain because they come down to us from mythological tradition. Then you also have some characters, like Dracula, who are public domain because the guy who wrote it died forever ago.

But is this Victor Surge's doing? From the first page this is action brought on by the two who have bought the option to make a film based on Surge's work.
