good advice!

i just went out to my local radio shack and purchased the suggested microphone product. Testing it on my home phones, it seems to work brilliantly. Thanks muchly for both the suggestion and the link Ariock.

Though i'm certainly hoping that a live call may come of my efforts tomorrow, http://forums.unfiction.com/forums/viewtopic.php?t=6190&start=60 but i'll not hold my breath.
In any case, i'll be able to record the calls (live or recorded) on my minicassette recorder, and will thusly be able to post much more accurate transcripts. Yay for precision!

If you recieve a call, you get the caller's "implied consent" over the rights of the phone call, and can do whatever you want with it. Tom Mabe (www.tommabe.com) has a few CD's out of calls where he's messed around with telemarketers which he can legally sell as his own product due to the legalities of phone calls.

Tom Mabe is also a resident of KY:

<snip>

KY laws do not apply in CA. And anyone who gives legal advice is actually liable for that advice, and subject to a suit for malpractice. Be very careful about giving legal advice.

DISCLAIMER: The following is not legal advice. It just looks like legal advice. If you decide to act in accordance with this advice, that is your own decision, and you assume full responsibility for the consequences. If you decide to sue me for malpractice, I will mock you mercilessly. I may also be forced to countersue for intense emotional distress and mental anguish. And I happen to know that there are at least a couple of lawyers on this forum. Mr. Green

Now: The California Penal Code generally makes it illegal to record a confidential communication without the consent of all parties. Although this is technically an "eavesdropping/wiretapping" statute, it definitely applies not only to that kind of situation, but also where one of the parties is the one recording it. I believe the minimum fine is something like $5,000.00 for each occurrence. There are exceptions -- law enforcement, for example -- but I don't think there is an "AI from the future" exception. (Laws like this, incidentally, are why you get that stupid "This call may be monitored to ensure customer satisfaction" message whenever you call pretty much anyone these days. Instant consent!)

Having said that, a "confidential" communication is one that the party may reasonably expect not to be disclosed to anyone else. If any of you actually get arrested for recording this stuff, I'd certainly argue that, even if the fictitious AI Melissa might have expected her crew not to disclose this stuff, the Real Life(tm) PMs who actually created it had no such expectation. After all, we know they're watching the forums, so they know that we (mostly) share everything, and therefore have no reasonable expectation of confidentiality. Q.E.D.

(Please note that this last sentence should not be considered an invitation to reopen the whole Weephun issue.)

just to dispell something ... as far as I know, it's not illegal to begin recording at the start of a conversation, just in case that when you ask if the conversation can be recorded, you don't have to go back in time... if they say no, all you have to do is scratch the recording.

So the law I think, anywhere, only comes into play if/when the recording is used or heard by another party. If you record for your own purposes and noone else ever hears it, it wouldn't be illegal.

So if you want to record, do it off the bat, then ask if the coversation can be recorded. If they say no, scratch it, if they say yes, keep it.

At least that's how I understand it...

(man, I keep wanting to use '' to begin italics... stupid wikis Very Happy)

Alright, im not a lawyar but i figure you can think of these calls as the same kind of thing as a radio dj pulling prank calls live on air. eventualy they let them know they are on air, and you either agree or disagree to be put on air. if you say yes, then its ok, if no. then its not. Im not really sure why we are worring about this in the first place.

Ya know, (yes I used ya instead of you, and gosh darn it I stand by my slang language!!!) I really don't think Bungie is trying to screw us here... in ANY aspect. From what I can gather this is just something they are doing for fun/raising public interest (cause you know, there isn't enough interest in Halo 2, like NO ONE even knows about it). I honestly think that Bungie knows that we are taking time out of our schedules to play this thing, and they are trying (whether or not they succeed, cursed axons, is debate for another place/time) to provide us with a little fun in return.

Honestly I can't see Bungie trying to sue us for recordings, as long as you don't make money off them, or throwing you out of the crew for giving away "sensitive information" (am not trying to sting Weephun or anyone specifically but alot of people have this strange mentality) or really just try and make the game less fun in any way.
*note* I mentioned Weephun and the info sharing thing because they come from the same "the man will screw me for it" mentality that I'm trying to discourage in this post, not because I hold any personal grudge against anyone who did this, because I understand that these people don't really understand that their actions are rediculous, thats why they act that way. The purpose of this post is to open these people's eyes to their own rediculous behavior.

oh and in case if bungie freaks out and actually does sue you, then I should know I'm not a lawyer and am not certified to give you legal advice, which is why this isn't legal advice. Just my opinion.

can anyone tell that I love parinthesis? (because I really do)

(really.)

If you think this game is for the fun of it Alex, then those secrets are a great idea. I sure as hell wasn't expecting that to happen, and I am certain that there will be a few more of these suprises down the road.
