I think a lot of people here that are getting all ruffled over the copying factor don't understand what copyright, literally, means.

Anyway, as an ex-Microsoft employee, I have no doubt that the action they take on anyone would be slim at best, especially for distributing a DVD collection of audio clips already offered for free, both for download and in disk form.

My offer still stands. If you cannot get a copy from Dana or whatever, I will send out a few to those who request them. My e-mail address is in my profile.

From what I understand - I spoke to an attorney yesterday - and I admit first that the knowledge I have isn't very complete:

of the three types of IP protections, copyright is the most relaxed. Patents are the strongest, and trademarks fall somewhere in between.

Now, as the creators of the work in question, 4orty2wo/Bungie/Microsoft hold the copyright. Now, while they posted the Audio content up on the web for all to have, there are some other things on the DVDs that are not on the web. Now, here comes the big part:

The methods they are using to distribute the DVD is controlled. You either have to
  • Go to a training event in one of four locations.
  • Go to one of 27 specified locations and give a passphrase.
  • Email Dana at her gmail account.


So that seems to indicate that they wish for us to not be burning and copying etc. A direct statement by MS could probably let everyone know what is up, and one seems to have been provided by Chuck Blevens via SuperJerms.

That being said: it is not direct from the horse's mouth, so to speak, and if you were just burning a copy for a friend who couldn't make it and no money/other compensation changed hands then they probably won't come and shoot your dog. HOWEVER, if you are going to try to SELL them or make profit, you will lose. ALSO, consider the fact that if they did want to come and get you for just handing to a friend, they could, as you technically copied and distributed a work that you did not hold copyright for. It's just highly unlikely.

One last thought: I personally emailed Dana, it is always worth a shot to go about this through the preferred method. And as Mazian always says if you're going to copy DON'T ADVERTISE THIS, especially in someplace that 4orty2wo employees (at the least) are known to frequent.

I doubt we're going to get a press release from Microsoft on this.

But does not the marketing head announcing it to an auditorium to "share" either A) Waive certain aspects of the copyright, barring sale and other for-profit methods of distribution, or B) Put the target on his ass if he told us publicly to do something that we shouldnt, considering his position?

Agreed. From what I've seen, SuperJerms is a credible source, and therefore his information from CB is also the truth.

That being said, I'd still like one with the fancy art on it, and as such I emailed Dana.

And while CB may have announced it and the "target is on his ass", it really depends on how the Judge is feeling if litigation was to ever start. (such a fine grey area, the law, never lets us normal folks know what we can and cannot do with much specificity)

Edit: Just to add in case I buried it before. Just don't sell, or talk about it, and life will probably be just fine.

It's funny how some of you bitch about the people who want to distribute something for free that they got for free.

People are selling these on ebay, y'know? Those are the ones you should be going after.

And some of us couldn't get to any training events, or receive any axons, no matter how much we were into the game. Sucks to live in other countries and be massive Halo fans (hell, I've been begging game shops for their displays...).

I'm gonna email Dana, because I may as well try. I can't see anything come of it though.

Y'know, Microsoft come down on people who pirate Halo 2 because it is a game you pay £35-40 for. (It is also a game I will gladly pay that for, I have the special edition on preorder.) I can't see why they would come down like a ton of bricks on those who want to share something they didn't pay one. damn. penny. for with the other people who can't get to those damn events though. We did as much and we love it as much as you americans.

Wow, this irks me more than I thought...

I'll shut up now and resume polling those stores for more stuff. (I got a window sticker last time, in the only shop I didn't buy anything in... so not going to happen this time.)

what I think is really funny
about this whole fight over the right to copy it.
1. it was given out for free.
2. microsoft knows how many people copy there stuff, and if they didn't want it donr they would make an effort to keep it from happening.
3 most of u who are saying there gonna turn people in for copying it, you probablly download more stuff from the internet then others,
just calm yourselves. everyone has been working together so well for so long, now your fighting over copyrights??

I'm not even touching the copyright law thing since I don't start that part of law class for a couple weeks...

I just wanted to say that I think it's really cool that they put the picture of a rotary phone dial on the DVD, and the syringe.

Also, is anyone else having trouble loading the first version of Jan Ch. 7 under the "making the audio" (sorry, I don't have the DVD in front of me and I don't remember the name) section? It works on my actual DVD player, but crashes the DVD player on the computer whenever I try to play it.

I wasn't aware just how devalued the canadian currency is against the dollar nowadays Smile

Now, I dunno if you can trust that SuperJerms fella, but there were multiple witnesses too. MS could rescend it, but they wouldn't because a) the whole marketing thing I said before and b) it would go over like the Nintendo/Suicide Girls thing. They won't do it.

Copyright really is an worksmanship owner thingy, so it's all good. Like has been said, it's a mark of who gets paid in a paid reproduction scenario. And this is a free distribution scenario until MS says otherwise.

Ebay is legal too, if they're selling their personal copies (not extras given out or burned copies...just the original dvd). It would be like selling a CD someone gave you as a gift. That's a slap in the face to the gift giver, but not a copyright violation. And, like a gifted CD, you couldn't burn a copy and sell that legally. But anyone who sells the lanyard or DVD they recieved as a gift at an event...totally legal. Lastly, anyone selling extras that were given to them for free distribution...that's unethical, but I dunno if it would be illegal or not.


If you object to the bitTORRENT thing, do as Marzain did and report it to MicroSoft. They won't do anything, but you will be able to sleep at night. And everyone wins so long as nobody decides to get all pissy with eachother.

As for folks from out of the country getting upset about the discussion. It's an honest discussion, and there are still ways to get DVD's, so be cool.


Oh yeah, I almost forgot. Anyone who is truely unable to scrounge together the couple dollars to mail a dvd to you. It's unbelieveably difficult to muster sympathy for someone who can't muster a couple of dollars, consider those who drove 10 hours, bought train or plane tickets, or paid for others to come. I can appreciate those feeling left out because of distances, but pah-leeze. I can send a letter to Timbuktu for 34 cents US. A DVD fits into a standard 5x7 padded envelope. It can't cost more than $2 to send that. I think you're gonna have to work harder to earn some pity there. Or go find yourselves a torrent.

And no, I'm not typing angry or sarcastically.

edit: I just realized the DVD has "not for resale" written clearly on it. Nevermind, I was wrong above. That's clearly an illegal violation if it disallowed resale.

You are possibly correct. And I have already tendered a tentative retraction. I do not, however, retract my hardline stance against piracy of Bungie products (including ILB).

To be clear: That we have (presumably) been given permission to duplicate for free all material on the ILB DVD prevents it from being piracy, and therefore I have no issues.

I'll go yack about people selling the DVD instead, ok? Razz
