not if he was able to transfer himself. It's a possibility that he found a connection between all the different city of the matrix and by that way didn't get deleted at the reload when the one choose the path to the core...

no, Avery cannot be smith. But maybe he is like an NPC in the world.
A program designed to lead this company to developing the MetaVRX, and then the Merovingian maybe took over at this point, or another program. Or maybe its all played out to happen this way.

But whatever, we must figure out why Beth is seeing James and how?

Maybe she isn't seeing his image, but she is seeing his work? or getting notes from him?

Well it explain the mail. She probably start receiving tone of documentation from James and she is looking for more when she can. That explain why she watch the file on Marcus desk and probably on the computer. So James know something he souldn't and hide himself? By hacking? Or maybe he tell to people to watch underscoring server for more information about what he discover or to simply try to put an end to metacortex project....
