but why Question - the darn capsule-things that contain the toy surprise are so hard to open a 3 year old couldn't possibly get to anything to choke on!!!

Seriously, I was intrigued when I first learned about these years ago. I'm in Florida, but haven't heard anything about the banning. If I hadn't bought so many *cases* of them, and got my fill of them back then, I would just look for more on eBay. Keep in mind, they travel better in winter. Razz

It was on the news in florida where I heard about it, LOL, it was a bit strange though.

Then again, we're also the place where it has to say "Warning: Contents May Be Hot" on a cup of HOT coffee because some bitch accidentally spilled coffee on herself and burned herself through 2 layers of clothing.


While I agree with George Carlin and you that we are overprotecting our children here (they're kids dammit ... they get bloodied and keep going ... that's what kids do!), the point about the woman who burned herself is a bit harsh. The actual case found that the temperature of the McDonald's coffee was 20 degrees (farhenheit) hotter than any of its competitors. The only reason it became well known was that McDonald's repeatedly refused settlement requests from the victim's counsel thinking they would win in court. Doh!

The lady only ended up with a few hundred thousand (a judge later reduced the penalty from the $5M she got down to $750K and supposedly they settled for around $400K). Still, if you are going to be foolish enough to put a cup of hot coffee between your legs, you might want to take into account that you could get burned if you are not careful. Or at least know a good lawyer (*e_nygma resists urge to make lawyer jokes*).

Now, if the lady had sued the maker of her car for not giving her cup holders that would be entirely frivolous ... sort of like the woman who sued a fast food chain (want to say it is Hardees, but I'm not sure) because she went into one of their restaurants SOLELY for using its bathroom (she was not a customer), went into a stall, slipped on the floor, and banged her head against the porcelain. She sued the chain because they had not put a "Floor May Be Slippery" sign INSIDE of the stall. Now I ask, how does one do that and leave room for a human to actually USE the stall? For what it is worth, the chain settled out of court for an undisclosed amount of money. Rolling Eyes
