UK Law to prohibit shills, affect on ARGs?

I hadn't noticed this being discussed yet, if it has, please feel free to trout me.

I would like to discuss how we think this will affect commercial args as well as interactive fiction and "hoaxes". For example, lonelygirl15 mentioning pfizer's anti smoking medication "Chantix". If readers don't know it is fiction, through ignorance or otherwise, is it criminal?

Does it have to be a paid endorsement or will just the mention of a real world product by a "hoax" site fall prey to the law as well?

What are your thoughts?

Just reading the first paragraph of the story makes me think this does not apply to a third party mentioning a product name. The intent is to stop people from shilling for their own products themselves thru fake identities.
