If everyone pulls together and keeps their records straight, it will work.

Records

Who did you contact, the date, time and who you spoke to or emailed.
How many times you contacted them

Via phone, who did you talk to, name, date and time
Via Email, from who, and date

**note to others*
I did not win on DR, I actually only caught the tail end of December on.
But I loved playing and have met some really nice people from there too. I hate to see anyone get "jipped, or cheated" out of what was won by SA/DR Rules.

Also I firmly believe that if MTV knew about all the payroll problems they may not have laid down in bed with SA/RD and totally screwed up a good game.

I hate the music, I hate the no brainer game, I hate the slot machine with no "logic"

hm I dont even like using the word hate.

I would like to know though how gt606 has 40 thousand plus points and kimgirl is around 15k +. amazing uh? (something fishy to me but thats just my opinion)

I have seen flaws in the *NEW* poor excuse of a game where at the slot machine, keeping good track of the numbers a number should have dropped and didnt.
Once I had 5 numbers drop and the 6th number didnt drop.

DR there are a lot of flaws in your tech dept.

Mad
I think I have done enough ranting abour raging for the night, sorry

I do not call, I only correspond with them via emails - writing

I can have proof of everything they have told me that way Smile

[edited to add] tomorrow is the 90 day mark from when they received my notarized (overnighted) paperwork. IF No check tomorrow, I will begin my case with the Arbitration company and give them my CC# to pay my filing fees. I have not heard directly from anyone else who is interested in filing with me for only 1 case & I know they have been contacted, so I will apparently be going it alone.

Thanks wench (love the sn, btw) Yep, full headers will be present when it gets to the table - if it even gets that far. A lawyer friend of mine reminded me that since DR has broken their own "contract" (official rules) by taking longer than the posted 60 days to send out prize awards, that the rest of the "contract" becomes null & void. So basically, If I wanted to take them to small claims court, I could & not even use the arbitration. But as another person reminded me, since DR is in California, the damages can be multiplied by 3, so it can't hurt trying the arbitration first.

Hey I just sent a message to someone that won twice,
Duhhhh *banging head on keyboard* I never even thought of him and we see him every few days.

Another thing with this arbitration,

Your cost will be returned to you with a successful win.

When jack gets back to me I will send him here,

be safe all

 Trivia

Hey everyone! Before they took the forums away over there, I had posted a thread for a trivia game for all of us to play. I wanted to post the link here so the rest of you can join RedHatty and myself. Just 10 timed questions a day.....probably not even 3 minutes out of your day! Won't you come see how much trivial crap is in your brain?

rage friends

Hello to all my Rager friends out there. I stumbled onto this forum almost by accident and got really excited to see so many people form the Rage forum posting here. I have to agree with you all on the new Rage....simply horrible....mindless...no challenge at all...It has gone from a game I would have paid to play, to a game I wouldn't consider playing without a payout...Now it seems they haven't been paying. I have a friend who won on Dec 6th..no check yet...and she would likely be interested in joining forces with you RedHatty..I will get back to you on that. I have also noticed the problem clicking the gems, but this is really weird...I play at the office and at home and at the office my screen comes up bigger and I can always get near 300 tokens on the gear game. On several occasions I got all the gems..totaling 310..but at home I get the small screen you all talked about and I'm busting my butt to get 150 tokens....To increase tokens I found you need well over 200 for each win...otherwise you will get to zero pretty quick...I have accumulated 6000 tokens but can only play at work or my number just goes down....I can not figure out what setting are different, but for those who get the big screen and have alot of time I to play 40,000 tokens to date is not unreasonable....I just can't imagine how someone could play this boring game that long.....

Anyway good to see all your names in print, I have missed talking to you all each day...Now we need to get Irr over here and it will seem like home. RedHatty I am going to start playing here and may be looking to you for some rookie advise if that's ok....

I figured out this am how to make the game bigger in both IE and Firefox. Lemly had mentioned in her blog about using the F11 key. You hit the F11 key then refresh the page.

Has anyone else noticed on the daily winners list the number of people who have their name on the list multiple times? One family 4x each for 2 people. The multiples are all new players. The entries might be different cases or a nickname Andrew vs Andy, most are blatantly the same. I realize if they get picked it should automatically disqualify them. However the increased numbers throws off a legitimate drawing, at least in my mind.

Welcome to my other World DrHermy Smile Any newbie help you need, i am but a pm away Smile plus you can find quick linie buttons to aim, yahoo & email at the bottom of my avatar/post Smile

Well I sent a pretty snarky letter to RP/DR yesterday & low & behold, I get a reply from their "general council" (Susie fwd'e it with a warning that legal action was threatened - didn't bother with the first one) So for all to see just how lame this organization really is, here's the leter I received
Quote:
Your email below has been forwarded to my attention. I am the General Counsel of Riddle Productions.

First of all, let me express my apologies for our apparent failure to pay your prize on a timely basis. There is no intent on our part to deprive you or any other prize winner of their prize. We would be delighted to pay all of the prizes on a timely basis. We love our players and want to create good will, not soured expectations.

Unfortunately, we are a start-up company and sometimes finances don't match up with the needs of the company. Although it is of no consolation to you, please understand that your obligation is not the only one not being met at this particular juncture in our Company's short history. Indeed, my salary has been deferred for the past month, and I do not enjoy that one particular bit.

I would like to say that I can instruct our accounting department to write you a check immediately, but I am not certain it will be done. I will, however, make immediate inquiries in that regard.

I believe you are incorrect with respect to your interpretation of the arbitration clause in our Official Rules. That clause is binding in all disputes, otherwise why bother putting the language in there? No one needs an arbitration clause when all is going well! I am very confident that if you were to pursue an adversarial proceeding, any court action would be dismissed and you would be assessed court costs and attorney's fees for bringing a lawsuit instead of an arbitration proceeding. I urge you not to do something so foolhardy and I personally would not want to be compelled to seek such sanctions from you.

What I would like to assure you of is that Riddle Productions is made up of well-intended individuals working their hardest to create interactive games that bring joy to our players. We are not out there to lie, cheat or steal. We charge no fees. We don't trade on personal information. But sometimes bad things happen to good people. In our case, we are low on funds. Many employees of Riddle share your pain in that regard. For that I apologize.

The Company will make good on our apparent obligation to you. I ask for your patience.

I am constrained to add that nothing contained herein shall be deemed a complete statement of our rights, obligations or defenses, all of which are expressly reserved.

Sincerely,

David Stern

Gee, Red, sure you're not shaking in your boots!!! They are very aware of the 3x rule, so if they can scare you off, they don't have to pay....Ever hear of a lawyer not gettting money??? Low on money after getting together w/MTV....Hmmm, strange

Now, I'm going to get my tea, and find a game to play here...

Hi just and Dr! I'm glad to hear from you both!

I have been working away from home.....and even though there is a business center with a computer to use at the hotel I am in, I have not played the MTV-DR game in a week.......I have no interest in the game the way it is. I saw an ad for it on TV yesterday and it 'bout broke my heart, knowing what the game WAS and what it has become.............

I would be interested in joining any action taken regarding the DR checks, but I don't have funds to pay for legal representation. I heard from Tech Support last week telling me it won't be much longer, yeah right, ok.

Okay, bottom line from the Arbitration cmopany - we cannot do a "class action filing" Only on an individual basis. There are specific steps that must be followed they can be found HERE.

I have heard quite a few people say that the $125 to file is too much for them. Please check out Fee Waiver Guidelines. basically what this lists is family size & income level (200% of federal poverty, unless you live in California, then it's 300%) if you meet these guidelines, you can have a full waiver of fees. The form for CA residents can be found HERE Non-CA residents, call the Western Case Management Center at 1-877-528-0879 to file for the waiver.

Nutshell summary:
we send notice to DR & AAA(with fees or waiver), then DR has 10 days to reply & pay their fees (alot more than ours!- total of $950 PER filing), then as soon as AAA hears from DR, an arbitrator is appointed(or at the end of the 10 days if no reply)
The arbitrator contacts both parties & then you have 7 days to present your evidence. Either party can request a hearing (but i doubt that DR will as it will cost them in the end & they know it) parties can also agree not to have a hearing & abide by the decision of the arbitrator.
Unless the parties agree otherwise, the arbitrator must make his or her award within fourteen calendar days from the date of the closing of the hearing. For Desk (no hearing) Arbitrations, the arbitrator has fourteen calendar days from when the AAA sends the final documents to the arbitrator.

The arbitrator may grant any remedy, relief or outcome that the parties could have received in court. The award shall be final and binding.

This means that in your INITIAL filing you have to request the 3X damages allowed by CA law!

This can take over a month Sad But if you go through arbitration & DR STILL drags butt to pay you, THEN you can take them to court & (depending on what the arbitrator decided) go after 3X AGAIN (as per CA Law, since the Official rules state that DR is bound by CA Law)!

So it's every Rager for themselves. Sorry, I really was hoping to have us all file together.
