I had trouble attaching it as a file so here it is:

Mr. Craig Becker
Director
Neotech Research Unit
Catalina, Arizona
Re: Preliminary document request

January 29, 2004

Dear Mr. Becker,

The Equal Employment Opportunity Commission (the ”EEOC”) enforces, among other statues, Title VII of the Civil Rights Act of 1964, which prohibits
employment discrimination based on race, color, religion, sex, or national
origin and, sections of the Civil Rights Act of 1991. In addition, Executive Order 12067 provides for the EEOC to coordinate all Federal statutes, Executive orders, regulations, and policies which require equal employment opportunity without regard to race, color, religion, sex, national origin, age or handicap among federal agencies.

In the immediate context, you will note the EEOC has a particular mandate to protect foreign nationals from discriminatory hiring practices.

Neotech Research Unit (“NRU”) is a federal agency under the auspices of the Department of Homeland Security’s Historic Crime Research Department (“HCRD”.) As such, NRU must comply with the relevant federal laws as well as assist the EEOC in coordinating the hiring policies among federal agencies.

Recently, the EEOC has received several complaints from foreign-born scientists who have been denied employment at certain federal research facilities. Similar complaints have been filed against HCRD. While no complaint as been filed against NRU directly, relevant employment information is essential in our investigation of the validity of these complaints. At the same time, an evaluation of the current hiring practices at NRU will help prevent any future discrimination.

The EEOC hereby requests employment records, including, but not limited to, applications, interview records, evaluations, employment history of all current and former employees of NRU, and written evidence of the basis for hiring decisions. The national origin of each applicant and employee must be clearly designated. The EEOC normally requests records from the past five years, but as NRU is a relatively new facility, records from the date operations commenced will be sufficient. Should the preparation of the physical documents prove burdensome, online review is available.

Your cooperation with this request will help us resolve this matter expeditiously. Please contact me should you have any questions regarding this matter. Also, our informative website www.eeoc.gov may be able to answer any routine questions you may have.

Sincerely,

Grace Harris
Staff Attorney
Equal Employment Opportunity Commission

I like the way it is worded, Rose, "as NRU is a relatively new facility, records from the date operations commenced will be sufficient."

This way we get to find out when the Mountain unit went on line and if it was the same time as the basement of the Fock Center. Nicely done!

Rose, have you heard anything from your EEOC request yet?

I got this today. I will continue to follow up with Backer.
Quote:
Ms. Harris,

Thank you for resending the aforementioned message. I have forwarded
your
request to my immediate superior at HCRD and asked him to follow up
with you
directly.

As the administrative head of Neotech, I don't have final authority on
decisions relating to technical or research staff. I'm sure that there
are
sound reasons for any hiring decisions made, security concerns
notwithstanding.

Please feel free to follow up in the next week if you don't obtain a
satisfactory response to your request for information. I assure you we
portray the highest ehtical standards here at Neotech and any
misunderstandings can easily be corrected.

Respectfully,
Craig Becker
Neotech Research Unit
Historical Criminal Research Dept.
