1. intestate -- adj., (law) having made no legally valid will before death or not disposed of by a legal will; "he died intestate"; "intestate property
Hence the "answer" to it being "tears".....and the end of the clue mentions how the question (test ) was "state d".....and it fits....lol
The question and answer parts of the clue point to "test ", the end to "state" and the whole thing to mourning (tears ).

It looks as though #3 Down could start with "sub" as in "subordinates", which could mean the next part is "tra" from "traveling", but the only thing I could find that would fit with the "e" is "Subtrahend".
Now I could see where the "sub" comes in, and the "tra", but "hend" isn't a word. Although "hende" is a word, it means skillful; dexterous; clever ......which to me doesn't say "vigor".
Anyway thought I'd put it out there and see if anyone else sees anything in it or can view it in a different way?

How sure are we about the "Intestate" answer? The 1980 song "Sailing" (by Christopher Cross -- hmm, chris cross) otherwise kinda fits, especially with the "it tanked" part, and "ailing" is sorta lamenting. Though I don't know where 1920 would enter into it!
If we ignore both I's, I'm partial to "The Rose" (by Bette Midler), since the "lamenting character of troubled lives" + "it tanked 60 years earlier" could refer to Titanic , i.e. the character "Rose" from the movie....? Except that the ship sank in 1912, which was 68 years earlier than 1980... Oy, I really do suck at these things, LOL!

11 Across might be : Emnity. It sort of fits. There's a NY in there and it means to hate.
