Legality of Filming...

Okay so I just realized that I may run into legal trouble with my ARG. I have planned to have one of my actors in out-door settings, filming themself, alright?

Well I just realized that if the camera captures anyone on film, dont you have to get a consent form from them or something? So wouldnt that mean that if the actor went to a park to film their surroundings and their walk, etc. that they would have to get consent forms from everyone in the cameras view?

Or in todays day and age of putting everything on film and then on the internet that it doesnt matter? I figured id ask because that could be a big deal :-/

if your ARG is an indie, i wouldn't fret over it. i've worked on many projects (indie ARGs, films, and online content) where we "stole" shots. it hasn't been an issue. i really doubt you'll get snagged for it. are you a student? if so, you can say its a student project.

Shoot the video with a limited field of depth, so that we see the main actor and his/her immediate space. But anyone walking behind or any signage in the background wouldn't be in focus.

Or, as labfly said, don't worry about it.

If there is no commercial purpose (not for sale) and the people in the background are not speaking, in the main focus of the camera, and they know you are filming something so if they get in the line of sight it is of their own free will, then you are probably going to be okay.

We do it all the time. If properly permitted, you can simply hand posters in a visible area with language like this:

You acknowledge and agree that by entering this area, your image, likeness or voice may be recorded (by any form of audio or visual recordings), and that any photograph, film, audio file or images of you taken by PRODUCTION COMPANY or any third party may be published, broadcast, transmitted or otherwise distributed by PRODUCTION COMPANY or a third party worldwide in any form of media (with or without identification) for any purpose, including for commercial gain, without compensation to you.

Plus if I remember rightly, it is not illegal to film in a public place.
The issue will come with the broadcasting of said images.
Petty difference I know, but a difference all the same.
For private locations (Car Parks, Private roads, Hotels, restaurants etc. it is best to request written permission to film on those grounds, or else you could find yourself being turfed out.
Just some stuff I picked up as a student director a few years ago.
