Yeah, funny thing is I don't like MickyDs. I was there because I was wondering why IGN had free video game guides. Kinda a strange little path I followed.

Unfortunately, you couldn't sue McDonald's even if you didn't like your photo up there for advertising purposes. All the legal angles are covered by the Terms of Use contract on the main Lost Ring website:

Including, as we see here, your photo without your consent, or videos you post to game websites, etc. I am researching this aspect of the game's marketing structure and I'm interested in feedback from players.
