ARG based/inspired by copyrighted content?

A friend and I were thinking about [once my current ARG is over with sometime this summer-ish] maybe planning an ARG based around VFD and Snicket's little universe. I think it sounds like an awesome idea, like looking up websites for scraps of info and such just like L. Snicket himself or maybe have someone who was a family member of a VFD member [post-schism] looking for clues about what his/her family was involved in or something?

But, it would be based on Snicket's works, so... I know the Hunger Games had an unoffical ARG and quit when an offical ARG showed up. Would it be possible to do this? [I dunno, it would leave a bad taste in my mouth if I did that and someone thought it was actually associated with Handler/Snicket]

I guess... if I really wanted to, I could ask Handler himself for permission. XD

Should I just forget the idea before I want to do it even more than I already do? What do you think? "An Unauthorized Alternate Game"? Oo

It wouldnt be the first time it was done, but it usually gets messy. If the company your mimicking does not like the publicity you are putting out, they wont simply shut you down, they will probably sue as well. See the problem with an ARG doing that is simply this, by nature, the content once created and displayed belongs to the players, not you, so lets say the owner of the company catches on to what you are doing and decides they do not like you doing it, and they say you have 90 days to erase it from the internet. You can erase the sites you put up, but you cannot erase the interaction. Thats the area that leads to lawsuits.

You should ask copyright owners. Free advertising is good for them, right?
Especially if it's good and will be accessible for a while.
